Step 1
Submit Your Application
The employer completes and returns Hemisphere Agricultural Solutions' application form to begin the process.

Receive and Sign the Employer Packet
We prepare and send your employer packet for signature. If you start early, we’ll ensure the documents arrive 2–3 weeks before the due date to avoid any processing delays.

Return Signed Documents
Return your signed documents by the date listed, 75 days before your requested start date, which is the earliest day we can file your H-2A application. Missing this deadline may delay your entire timeline.

State Workforce Agency (SWA) Filing
We submit your job order to the SWA between 60–75 days before your start date. Our goal is to file at the 75-day mark whenever possible to maximize processing time.

Department of Labor (DOL) Filing
Once your SWA job order is accepted, we submit your application to the DOL, typically within a week. This step must be completed at least 45 days before your start date.

Notice of Acceptance (NOA) or Deficiency (NOD)
If your application is accepted, DOL issues a Notice of Acceptance. We’ll then submit your recruitment report, including results from U.S. worker outreach.

If a Notice of Deficiency is issued, we have 5 business days to respond and correct any issues.

Labor Certification Issued
Once approved, DOL issues a Labor Certification at least 30 days before your start date.

Delays in housing inspections or missing documents can hold up certification, so timely responses are essential. If this step is delayed, worker arrival may also be pushed back.

Submit Petition to USCIS
We file your petition with the U.S. Department of Homeland Security (USDHS).

Note: Until we receive a receipt notice from USCIS, we cannot schedule consulate interviews. This notice typically arrives 2–3 weeks before your start date

Notice of Action
USDHS sends a Notice of Action confirming approval, denial, or a request for additional information. This usually arrives 1–2 weeks before your start date.

Consulate Appointment Scheduled
Once the receipt notice is received, our team in the worker’s home country schedules the consulate appointment for the earliest available date.

(Appointment timing depends on availability and is outside of our control.)

Visa Interview at the U.S. Consulate
Workers attend their consulate interview and pay the $190 visa fee, which should be reimbursed during their first week of employment.

If a worker held an H-2A visa the prior year, they may qualify to submit documents by mail instead of attending an in-person interview.

Flight Booking & Passport Return
Once the visa is approved, we begin tracking the passport and prepare flight options. Flights are not booked until the passport is in hand to avoid cancellations or lost tickets.

The worker purchases the approved flight and departs as soon as their passport is returned.

Your workers arrive in the U.S., ready to begin work on time and fully supported by Hemisphere Agricultural Solutions, LLC.
